The following Terms & conditions (hereafter "Terms") directs Your use of Three horses SIA web site: www.store.3horses.lv (hereafter "web site"). It is important that You read the Terms carefully, as Your use of the web site will automatically constitute your agreement to be legally bound by the terms and conditions set out herein. These Terms also govern your purchase of the products provided through or in connection with the web site (hereafter "services"). Each time You use our services, You agree that you have read these Terms and agree to be legally bound by them. If you do not agree to be bound by these Terms, You may not use the web site or the services provided by Business through its web site.

You need to be over 18 years of age and have the right to enter into an agreement in accordance with applicable law, e.g. not be under guardianship. 


The web site is owned by Three horses SIA (hereafter “Seller”), registration number 40203448170, registered at Bezdelīgu iela 5, Piņķi, Babītes pag., Mārupes nov, Latvija LV-2107, represented by head of the managing board Inese Vinvalka.


  1. Product description and price


We have taken care and tried to ensure that all details, descriptions and prices which appear on this web site are accurate, however some variations in items or errors may occur.

If an error in the pricing of a product is found Seller will contact you as soon as possible, to arrange payment of any extra sum due or refund any over-payment made by you (as applicable) or Seller can cancel your order if corrected price is not accepted by You and if you have already paid for the goods, you will receive a full refund.


All prices are subject to change without notice and are not guaranteed, except that prices for an order that have been accepted by the Seller.


The images of the products are for illustrative purposes only. In addition, Seller cannot guarantee that for example, your computer’s display of the colours accurately reflects the colour of the products. Your products may vary slightly from the images found in web site.

Seller may time to time offer promotional discount codes; codes can be applied in respect of certain purchase made though the web site. Only one promotional discount code can be applied to an order. Promotional discount code cannot be applied to already discounted products.


  1. Placing an order


Web site allows to place an order and at the checkout process You have an opportunity to view the details of the order. Order can be corrected at the chart, before payment is made. Upon receiving your order, order details will be sent via email.

Orders placed by You using the web site, is an offer by You to purchase the goods selected in your order. No agreement exists between You and Seller for the sale of any goods until Seller has received your order and accepted it (which Seller may do at its own discretion, see below). Seller acceptance of an order occurs when order confirmation sent by email to the You, even if Your payment has been processed immediately.

Seller may refuse to accept an order in the following circumstances:

  1. no authorisation for Your payment can be received by the Seller;
  2. error in the pricing or product description found;
  • criteria set out in terms and conditions are not met;
  1. ordered goods are not anymore available;
  2. delivery cannot be done to the provided address.

In the case when the order made by You is not accepted by the Seller, however payment is processed, Seller will refund any full amount deducted by Seller from Your account as soon as possible, or in any event within 30 days of the order. Seller will not be obliged to pay any additional amount as a compensation for the cancelation of the order.

Seller offers different payment options. The available payment options can be found in the web site at the check out.

A bank transfer is available in the case if customer choses to pay this way.


  1. Shipping and delivery


The Goods will be delivered to You at the address You provided at the check out which may be an address other than the billing address.


At the check out, You will have to chose the delivery options available and Seller will deliver products using this service. Information about delivery options can be found in the web page and at the check out. Depending on which shipping method You choose and the total amount of your order, shipping fees may apply. The delivery fee to You will be free, when Your order is 100 EUR or more and delivery address is in Latvia/Estonia/Lithuania. If Your order is less than 100 EUR, You will be charged for the shipment. Any shipping costs will only be added once per order, regardless of the number of packages in the order.


The expected delivery time can be found the web site. Please note, that in the order confirmation delivery time may differ. Seller will always try to deliver your order within the estimated number of working days for delivery, stated on the web site or/and in your order confirmation. In addition, that the time for delivery may vary depending on where products are delivered, what delivery option was chosen and the season of the year. If your order is delayed, Seller will notify the customer (You) and You have the right to cancel Your order if the delay has a significant impact on you.


If Your order contains several items and some of the items are temporarily out of stock, Seller will contact you and inform about the stock situation regarding ordered goods, Seller will divide Your order into several deliveries. The out of stock item will be delivered to You at a later date free of charge. In addition, the delayed item can be cancelled by You, if the delay has a significant impact on you.



You are responsible for picking up your order within the time stated on the delivery notice.


Packages that are not picked up within the time specified on the delivery notice ordered goods will be sent back to Seller’s warehouse. Seller will inform You about the received products and if you wish the order to be send again to the same address or different address, you will have to pay delivery costs again.



  1. Cancellation, return and refund


Seller may decline Your order if you have provided the Seller with incorrect information at checkout, if the Seller suspect an attempt to commit fraud or if the order cannot be completed since the product You have ordered is out of stock. In such cases, we will notify you as soon as possible.


  • Cancellation


According to EU consumer protection legislation, You have a legal right to cancel Your order within 14 days from the day You have receive the product (or 14 days from the day when some person on your behalf have received the product) that was purchased from the web site.

Within 14 days from receiving goods, You have right to open the package, inspect the goods to the extent required in order to assess its quality and purpose.

If You have handled the product to a greater extent than required to determine its quality and purpose, Seller has rights to deduct a sum from the refund.


If in any circumstances within 14 days, You want to exchange the received product, You shall return product and place a new order on the web site.


For certain products, no rights of return apply. If a product is not suitable for return due to health or hygiene reasons, you will not be able to return the product if You have broken the seal on the product. Also, You do not have the right to return a product that:

  • made-to-measure or custom-made products or products made to your specification or clearly personalised;
  • perishable goods, such as food.

To meet the cancellation deadline, it is sufficient for you to send Your communication concerning Your exercise of the right to cancel before the cancellation period has expired.


  • Return

If You decided to cancel the order within 14 days from the received day, You shall inform about Your decision to the Seller via an email threehorses.inese@gmail.com .

Goods shall be returned without undue delay and in any event not later than 14 days from the day on which You have informed the Seller about the agreement cancellation. The deadline is met if you send back the goods before the period of 14 days has expired.


Goods to be returned to Seller prior to any refund taking place.


The cost of the return shipping must be paid by You (customer).


  • Refund


If You decided to cancel the order within 14 days, Seller will return to You all payments received from Your account, excluding the costs of delivery.

If You are not satisfied with purchased goods, Seller will be happy to accept Your timely return of unused, unwashed, or defective merchandise. Used merchandise cannot be returned unless defective. Returned merchandise should include the packaging and tags and be in the same condition as when it was received.

The refund will be done as soon as possible, but not later than 14 days after the day Seller receive back the goods, or 14 days after you have shown that you have sent return goods back to the Seller.

  1. Faulty Product, Damaged on Arrival

It should be noted, that all returned products that were claimed to have some defects will be checked and verified by Seller or producer. It should be noted, that if no defects are identified in the returned product, it will be shipped back to You and all transportation costs will be charged from your account, via your original payment method or hold the product until full payment has been received by Seller for the return transport costs.

In the case, if You notify a problem to the Seller under this condition, Sellers only obligation will be, at your option:

  1. to make good any shortage or non-delivery;
  2. to replace or repair any goods that are damaged or defective; or
  • to refund to you the amount paid by you for the goods in question in whatever way we choose.

Save as precluded by law, Seller will not be liable to You for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem You notify to Seller under this condition and Seller shall have no liability to pay any money to You by way of compensation other than to refund to You the amount paid by you for the goods in question as above.


  1. Limitation of Liability

The Seller will not be liable to You for any loss or damage in circumstances where:

  1. there is no breach of a legal duty owed to you by the supplier or by its employees or agents;
  2. such loss or damage is not a reasonably foreseeable result of any such breach;
  • any increase in loss or damage resulting from breach by you of any term of this contract.

Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.


  1. Rights of termination


Seller reserve the right to terminate this agreement by writing to You if you fail to make any payment to the Seller when payment was due.


  1. Complaints

Seller operates a complaint handling procedure that will be used to try to resolve disputes when they first arise. If you wish to complain about delivered product, please contact the Seller as soon as possible after an error was discovered.


To make your complaint, Seller recommends to use Product defect form, that was shipped together with goods. When Seller confirms that complained product has been received and if after product examination it was established that the complaint is valid, Seller will repaire the product or it will be replaced with a new one. It should be noted, that Seller has rights to decline a complaint if it turns out that the product is not defective according.



10.  Changes to legal notices


Seller reserve the right to change these Terms from time to time and You should look through them as often as possible, but the Terms that You approved at the time of your purchase will always apply to that purchase. The latest published version of the Terms will always be available on the web site.

Changes will come in to effect from the time You have accepted the Terms that is in connection with You making a new purchase on the web site.


  1. Obligations of user

User (You) must not misuse this web site. It is is prohibited to use the web site as it is described below. These descriptions are guidelines and are not intended to be exhaustive or all-inclusive.

  • Illegal/Criminal Activity:The web site may not be used in connection with criminal or civil violations of Local, National or international laws, regulations, or other government rules or requirements. Such violations include theft or infringement of copyrights, trademarks, trade secrets, or other types of intellectual property; fraud; forgery; theft or misappropriation of funds, credit cards, or personal information; and threats of physical harm or harassment.

Examples include: improperly securing a mail server so others can use it to distribute spam; improperly securing an FTP server so that it may be used by others to illegally distribute licensed software or media content. User is responsible for taking corrective actions on vulnerable or exploited systems to prevent continued abuse.


  • Threats: The web site may not be used to transmit materials of a threatening nature, including threats of death or physical harm, harassment, libel, and defamation.


  • Offensive Materials : The web site may not be used for the distribution of offensive materials, including obscene, pornographic, indecent, and hateful materials. Further, Users (You) agree to adhere to the following requirements:
  • Comply with all laws, ordinances, statutes and applicable legislation and to respect all 3rd-party rights. In particular, User shall not: 
  1. Provide, post or otherwise distribute content which is defamatory, threatening, disparaging, grossly inflammatory, false, misleading, fraudulent, inaccurate, unfair, contains gross exaggeration or unsubstantiated claims, violates the privacy rights of any 3rd-party, is unreasonably harmful or offensive to any individual or community; 
  2. Use or post any pornographic materials or any content that violates any applicable legislation for the protection of minors; or advertise or promote, offer or distribute any pornographic product or products which do not comply with any applicable legislation for the protection of minors;
  • Unreasonably annoy (particularly with SPAM) any other User; 
  1. Use or post, without authorization, any content protected by law (e.g. copyright, trademark, patent, utility patent, design patent or other intellectual property (IP) laws), or advertise, promote, offer or distribute any goods or services protected by law; 
  2. Use, post or promote any commercial practices considered unfair competition, including progressive customer acquisition practices (such as chain distribution systems, Ponzi schemes, illegal multi-level selling or pyramid sales).
  • You may not provide, post or otherwise distribute, User content that: 
  1. Contains vulgar, profane, abusive, racist or hateful language or expressions, epithets or slurs, text, photographs, videos or illustrations in poor taste, inflammatory attacks of a personal, racial or religious nature; 
  2. Discriminates on the grounds of race, religion, national origin, gender, age, marital status, sexual orientation or disability, or refers to such matters in any manner prohibited by law or moral standards; 
  • Violates or encourages the violation of any Local, National or international law, rule, regulation or ordinance; 
  1. Interferes with any User’s uninterrupted use of the Business website; 
  2. Advertises, promotes or offers to trade any goods or services; 
  3. Uploads or transmits viruses or other harmful, disruptive or destructive files, material or code; 
  • Disrupts, interferes with, or otherwise harms or violates the security of the Business web site or any services, system resources, accounts, passwords, servers or networks connected to or accessible through the Business web site; 
  • "Flames" any individual or entity (e.g. sends repeated messages related to another User and/or makes derogatory or offensive comments about another User or individual), or repeats prior posting of the same message under multiple threads or subjects. 




  • It is Your responsibility to determine that Your input into web site, including use of any chat room areas of the web site, including your choice of your user name, conforms to the above conditions. If You notice any content which breaches these conditions, please notify Seller by email inese@gmail.com.


  • SPAM (Junk): Spam (junk) is an unacceptable use of the web site. Spam includes any of the following activities:
  1. Posting a single message or messages similar in content, to more than five (5) online forums or newsgroups and posting messages to online forums or newsgroups that violate their rules. 
  2. Collecting responses from unsolicited e-mail. 
  • Sending any unsolicited e-mail that could be expected, in Business’s opinion, to provoke complaints. 
  1. Sending e-mail with charity requests, petitions for signatures, or any chainmail-related materials. 
  2. Sending bulk e-mail without identifying in the e-mail a clear and easy means to be excluded from receiving additional e-mail from the originator of the e-mail. NOTE: The inclusion of an opt-out clause does not necessarily legitimize sending unsolicited e-mail. 
  3. Sending e-mail that does not accurately identify the sender, the sender's return address, and the e-mail address of origin. 
  • Using Sellers facilities to violate what could reasonably be considered a violation of another Internet Service Provider's (ISP) acceptable use policy and/or terms of service. 


  • The following activities are also prohibited:
  1. Employing any mechanisms, software or scripts when using the web site.
  2. Blocking, overwriting, modifying and copying of any contents of the web site.
  • Distributing or publicly disclosing the contents of the web site or any of its terms, without written permission from Seller, or
  1. Performing any actions that may impair the operability of the web site infrastructure, particularly actions that may overload said infrastructure, servers, bandwidth or other equipment or software
  • Indirect Access: A violation of these Terms by someone having only indirect access to the Business web site through a User, will be considered a violation, whether or not with User’s knowledge or consent.

Seller will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of this Website or to your downloading of any material posted on it, or on any website linked to it.


  1. General

In addition, these policies apply to any email or content transmitted by User, or on Your behalf, that uses a Seller account as a mailbox for responses or promotes content, hosted or transmitted, using Sellers facilities, or that indicates, in any way, that Sellers was involved in the transmission of such email or content.

The resale of Sellers products and services is not permitted, unless expressly permitted by these Terms or in a separate written agreement.

Violations of these Terms may result in immediate suspension or termination of Your account and our services to You, immediate temporary or permanent filtering, blocked access or other action appropriate to the violation, as determined by Seller, in its sole discretion.

When feasible, it is Seller’s preference to give notice so that violations may be addressed voluntarily, however, Sellerreserve the right to act without notice, when necessary, as determined by Seller in its sole discretion. Seller may involve, and will cooperate with, law enforcement, if criminal activity is suspected. Violators may also be subject to civil or criminal liability under applicable law. Refunds or credits are not issued in connection with actions taken for violations of these Terms.


  1. Online acceptance

You may not assign, sub-license or otherwise transfer any of Your rights under these terms and conditions.

If any provision of these terms and conditions is found by any court of competent jurisdiction to be invalid, the invalidity of that provision will not affect the validity of the remaining provisions which shall continue to have full force and effect.

No person other than the parties to these terms and conditions are intended to benefit from them pursuant to the Agreement.

These Terms represent the entire understanding between the user and the Seller and supersedes any prior statements or representations. THE USER AGREES TO THE TERMS OF THIS ONLINE AGREEMENT, by using the web site, it’s services, sign up, posting, downloading and uploading content, and understands that it is entering into a binding and legal agreement with Seller.

You agree to file any claim regarding any aspect of this web site or these Terms within six (6) months of the time in which the events giving rise to such alleged claim began, or you agree to waive such claim. You also agree that no claim subject to these Terms may be brought as a class action or in any other jurisdiction than Latvian courts.
